Guarantee terms & conditions
These are the complete eligibility conditions and limits for the six guarantees described on our property management pages. We publish them in full because a guarantee with hidden conditions isn't a guarantee — it's a headline. The version below is incorporated into every management agreement at signing.
1. Paid-on-Performance Guarantee
- Applies to RexMont's monthly management fee only. Tenant-placement fees, renewal fees, and third-party costs the owner authorized (vendor invoices, filing fees, utilities) are earned independently and remain payable.
- Does not apply for periods in which the owner prevents leasing — for example by declining to list at or below RexMont's written recommended rent, declining rent-ready repairs identified in the punch list, or restricting showing access.
- No vacancy fees means RexMont charges no fee merely because the unit is vacant; it does not mean vacancy-period services (marketing, showings, inspections) create no third-party costs.
2. 30-Day Leasing Guarantee
- The 30-day clock starts when the property is Rent-Ready (defined below), professionally photographed, listed publicly at or below RexMont's written recommended rent, and the owner has approved the written screening criteria.
- Met when a lease is signed within 30 calendar days of the clock starting. If not met, the tenant-placement fee for that lease-up is reduced by 50%.
- The clock pauses for owner-caused delays: declining an applicant who meets the approved written criteria, changing the price above the recommendation, restricting showings, or taking the property off market.
- Applies to unfurnished long-term (12-month) residential leases within RexMont's published service area. Furnished, mid-term (under 12 months), and short-term arrangements are quoted with their own terms.
- Hard costs are always recovered: RexMont advances real out-of-pocket costs on every lease-up — professional photography, showing-agent coverage, and paid listing placements. If this guarantee triggers, the 50% reduction applies to RexMont's service portion of the placement fee; the reduced fee is never less than those documented out-of-pocket costs.
- Withdrawn listings are not covered: if the owner takes the property off the rental market, or terminates before a lease is signed, after marketing has begun, the owner reimburses RexMont's documented out-of-pocket marketing costs, and this guarantee does not apply.
3. 12-Month Tenant Guarantee
- Applies when a tenant sourced and screened by RexMont under its standard written criteria breaks the lease, or is evicted for nonpayment, within the first 12 months of the tenancy.
- The remedy is a waived tenant-placement fee on the replacement lease for the same property. It does not cover lost rent, turnover repairs, utilities, or legal costs.
- Void if the owner selected an applicant against RexMont's written recommendation, waived any screening criterion, or supplied the tenant.
- Requires Continuous Management (defined below) from placement through the qualifying event.
- Excludes lease terminations required or protected by law (including early termination rights of domestic-violence survivors under RCW 59.18.575 and servicemember relocations under the SCRA), terminations caused by owner action (sale, owner move-in, uninhabitability from owner-declined maintenance), tenant death, and early terminations the owner agrees to voluntarily.
- One waived re-placement per tenancy.
4. Eviction Fee Guarantee
- Applies to nonpayment-of-rent evictions of a RexMont-placed, RexMont-screened tenant commenced within the first 12 months of the tenancy, on a property under Continuous Management.
- The remedy is a waiver of RexMont's own eviction-coordination fees. Attorney fees, court costs, sheriff and service fees, judgments, mediation costs, lost rent, and property damage are not covered (many are recoverable from the tenant in the judgment).
- Requires the owner to follow the statutory process through RexMont and its designated counsel: no separate agreements with the tenant, no self-help measures, and timely authorization of required notices and filings.
5. Pet Damage Guarantee
- Applies only to pets screened and approved in writing by RexMont for the specific tenancy. Unauthorized pets are excluded (and are a lease violation we enforce).
- Assistance animals (service animals and emotional-support animals) are not pets under fair-housing law, are not subject to discretionary approval, and are therefore outside this guarantee.
- Covers documented pet damage exceeding the tenant's security deposit and any pet-specific deposits or fees available, up to $1,000 total per tenancy. Ordinary wear and tear is not damage.
- Requires Continuous Management through move-out, RexMont's move-in and move-out condition reports as the documentation of record, and a claim submitted within 30 days of the move-out inspection.
6. Fair Exit Guarantee
- Initial term: nine months from the management agreement's effective date — the period needed to place, onboard, and stabilize the first tenancy, during which RexMont's up-front investment in the property is recovered.
- After the initial term the agreement runs month-to-month: either party may terminate with 30 days' written notice, with no termination penalty — ever. The agreement never auto-renews into another fixed term.
- Early exit during the initial term, at no penalty, in three cases: (a) the owner signs a listing agreement to sell the property through RexMont's brokerage — the remaining term is waived at signing; (b) RexMont materially breaches the agreement and does not cure within 15 days of written notice; (c) the property is destroyed, condemned, or otherwise permanently removed from rentable condition.
- Outside those cases, the agreement continues through the initial term and fees accrue per its terms.
- Fees already earned through the termination date — including management fees on rent collected and placement fees for tenants already placed — remain payable and are not refunded.
- All guarantees are benefits of an active management relationship: they end on the agreement's termination date and do not apply to events occurring after it.
- On termination RexMont delivers the tenant file, lease, accounting ledger, deposit accounting, and keys per the agreement's transition terms and Washington law.
Program-wide terms
- Eligibility. Guarantees 1, 3, 4, 5, and 6 apply to full-service management accounts (Essential, Professional, or Platinum Concierge) for long-term residential rentals inside RexMont's published service area. Placement-only clients receive Guarantees 2 and 3 (with the replacement placed at the then-current placement fee schedule's guarantee terms) and not the management-dependent guarantees.
- Owner obligations. Each guarantee assumes the owner maintains a current landlord insurance policy, funds legally required and punch-list repairs, maintains the property in habitable condition under RCW 59.18.060, and complies with the management agreement and applicable law.
- Exclusive remedy and cap. The remedies stated here are the sole and exclusive remedies under the guarantee program. RexMont's total aggregate liability under all guarantees for a property is capped at the total management and placement fees the owner actually paid for that property in the 12 months preceding the claim.
- Not insurance. The guarantee program is a service-fee remedy program, not an insurance product, and is not a substitute for landlord, liability, or rent-default insurance.
- Force majeure. Guarantee periods pause during events outside RexMont's reasonable control (natural disaster, government moratoria, utility failure, civil emergency).
- Changes. RexMont may update the guarantee program prospectively; the version incorporated into your signed management agreement is the one that governs your account. This page is version 1.0, effective September 2, 2026.
- Governing law. Washington law governs; venue for disputes is King County, Washington.
Definitions
- Rent-Ready
- Professionally cleaned; all habitability items under RCW 59.18.060 functional; smoke/CO detectors and locks compliant; repairs identified on RexMont's pre-listing punch list completed; utilities on for showings.
- Continuous Management
- The property has remained under a RexMont full-service management agreement, without interruption, from the tenant's placement through the event giving rise to the claim.
- Qualified Applicant
- An applicant who meets the written screening criteria approved by the owner before listing, evaluated in the order received where required by law (including Seattle's first-in-time rule).
